§1Who you’re contracting with
Crumb is a digital menu platform operated by Aleksandar Opsenica (sole trader), trading as Crumb (“Crumb”, “we”, “us”). By creating an account or using the service, you (“you”, the “Customer”) enter into a binding agreement with Aleksandar Opsenica on these terms.
You confirm that you are at least 18 years old and, if you are signing up on behalf of a business, that you have authority to bind that business.
§2Acceptance
By signing up, accessing, or continuing to use Crumb, you agree to these terms, the Privacy Notice, and the Refund Policy. If you do not agree, do not use the service.
§3The service
Crumb provides hosted digital menu software for restaurants, including a dashboard for managing menus, dishes, ingredients, allergens, languages, photos, and analytics, and guest-facing menus delivered via QR code. Feature availability depends on your plan.
§4Your account
You’re responsible for keeping your login credentials confidential and for everything that happens under your account. You must provide accurate information when signing up and keep it current. Notify us immediately if you suspect unauthorised access.
§5Acceptable use
You agree not to:
- Use the service unlawfully or for fraudulent purposes;
- Upload content that infringes intellectual property, is defamatory, misleading about allergens, or otherwise harmful;
- Probe, scan, scrape, or otherwise interfere with the security or integrity of the service;
- Introduce malware, attempt to gain unauthorised access, or reverse-engineer the platform;
- Resell or sublicense the service without our written consent.
§6Intellectual property
Crumb, including the software, design, branding, and documentation, is and remains the property of Aleksandar Opsenica. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have subscribed to, for the duration of your subscription. You retain ownership of your own menu content; you grant us a limited license to host, process, and display it solely to provide the service to you and your guests.
§7Payments, subscriptions, and Merchant of Record
Subscriptions are billed monthly in advance through our reseller, Paddle. Plans include a 14-day free trial; you will not be charged until the trial ends, after which the subscription renews automatically at the price shown at checkout until cancelled. You can cancel at any time from your billing page or the customer portal — access continues until the end of the current billing period.
Merchant of Record. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, applicable taxes, invoicing, and refund mechanics are governed by the Paddle Buyer Terms. §8Service availability
We work hard to keep Crumb available, but the service is provided on an “as is” and “as available” basis. We do not guarantee that the service will be uninterrupted, error-free, or meet every requirement. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
For paid plans we operate to an internal target of 99.5% monthly uptime, measured across the guest menu and the dashboard. This is a target, not a contractual SLA, and does not include planned maintenance, third-party outages (hosting, DNS, payment provider), or events covered by §13 (Force majeure).
§9Allergen and menu accuracy
Crumb is a tool that helps you publish menu, ingredient, allergen, and modification information to guests. You are solely responsible for the accuracy, completeness, and currency of the menu data you enter, including ingredients, allergens, may-contain notes, dietary claims, and modifications.
Crumb does not verify supplier-declared allergens, recipe contents, cross-contact risk, or kitchen practice. You must operate a kitchen process — supplier review, station-level review, and a published change procedure — that keeps your Crumb data aligned with what the kitchen actually serves. To the fullest extent permitted by law, we accept no liability for guest harm, regulatory action, or other loss arising from inaccurate, incomplete, or out-of-date menu data entered by you or anyone you authorise.
§10Suspension and termination
We may suspend or terminate your access if you materially breach these terms, fail to pay for your subscription, create a security or fraud risk, or repeatedly violate our acceptable-use rules. Where reasonable, we’ll give you notice and an opportunity to cure. You may stop using the service and cancel your subscription at any time.
On termination, your right to use the service ends. We’ll keep your data for 30 days after deletion so you can request a self-serve or assisted export (JSON or CSV), after which it is permanently deleted unless we are required to retain it by law.
§11Liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or related to the service is limited to the fees you paid us in the 12 months immediately preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, revenue, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury caused by negligence where excluding such liability is unlawful.
§12Indemnity
You agree to indemnify us against third-party claims arising from your content, your unlawful use of the service, or your breach of these terms.
§13Force majeure
Neither party is liable for failure or delay in performing its obligations (other than payment obligations) to the extent caused by events beyond its reasonable control, including hosting or network provider failure, denial-of-service attacks, governmental action, labour disputes, fire, flood, epidemic, or war. The affected party will use reasonable efforts to mitigate the effect.
§14Beta and preview features
From time to time we may label features as “beta”, “preview”, “experimental”, or similar. Such features are provided as-is, may change or be withdrawn without notice, and are excluded from the availability target in §8 and from any warranty whatsoever. Use them at your own risk and don’t rely on them for compliance-critical workflows.
§15Changes to the service or terms
We may update the service and these terms from time to time. If we make material changes to the terms, we’ll notify account holders by email at least 14 days before the new effective date. The most recent version always lives at crumb.menu/terms; the “Last updated” date at the top reflects the most recent revision. Continued use after the effective date means you accept the updated terms. For a copy of a previous version, email legal@crumb.menu.
§16Notices
Notices to us must be sent to legal@crumb.menu. Notices to you will be sent to the email address on your account; it is your responsibility to keep that address current. Notices are deemed received on the next business day after sending.
§17Assignment
You may not assign or transfer these terms or any rights under them without our prior written consent. We may assign these terms in connection with a merger, acquisition, reorganisation, or sale of substantially all assets, on notice to you.
§18Severability and entire agreement
If any provision of these terms is held unenforceable, the remaining provisions remain in full force and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. These terms, together with the Privacy Notice, Refund Policy, and any order or plan you accept, form the entire agreement between you and us regarding the service and supersede any prior agreements on the same subject.
§19Governing law
These terms are governed by the laws of Ireland. The courts of Ireland have exclusive jurisdiction over any dispute arising out of or related to these terms, except where mandatory consumer law in your country of residence applies.
